Daniel Miller has experience in both litigation and corporate transactional work. Mr. Miller has litigated issues in real estate, entertainment, commercial litigation, and intellectual property. He obtained a multi-million dollar award for age discrimination, age-based harassment and constructive discharge. The Award followed a three-week arbitration hearing and included punitive damages and an award of attorneys fees under California's Fair Employment and Housing Act. He also successfully obtained a preliminary injunction preventing a lender from foreclosing on a large condominium project in Long Beach, California. The injunction saved the real estate developer from losing their interest in the project.
After filing a summary judgment motion in a real estate dispute, Mr. Miller obtained a complete dismissal of a $4 million finder's fee claim in connection with the purchase of a $200 million property on behalf of a large land developer. He also represented one of the largest homebuilders in the country in a multi-million dollar partnership dispute over a large residential development project. In entertainment, he defended a prominent music management company in a multi-million dollar lawsuit for invasion of privacy, sexual harassment, unfair competition and other claims which resulted in a settlement under which the music management company paid nothing to the plaintiff. Mr. Miller also obtained a dismissal of all claims against the same music management company in defense of a lawsuit for unfair competition and interference with contract.
In transactional, he has worked on mergers and acquisitions, corporate finance and intellectual property licensing agreements. Deciphering transactional documents and working on intense corporate finance transactions has given Mr. Miller a unique understanding and background for litigation. Mr. Miller's extensive experience with corporate transactions makes him an asset to the firm's complex litigation practice.
His experience also includes representing a Fortune 500 biotechnology company in both litigation and transactional matters. He has represented the leading investment banks in the world, a public gaming company, an online movie distribution company and several other public companies in different industries. Mr. Miller also has extensive pro bono experience, including obtaining an over $3 million payment from the federal government on behalf of a client who lost a family member on the September 11th tragedy. Before coming to Miller Barondess, Mr. Miller practiced law at Latham & Watkins for approximately four years.
He received his Juris Doctorate from the University of California at Berkeley, Boalt Hall School of Law in 2001. He graduated from UCLA, summa cum laude and Phi Beta Kappa, where he received a Bachelors Degree in Psychology.
